CLIENT AUTHORIZATION

You have hired Kimberly D. Kovach, Esquire to provide you with legal services regarding a simple uncontested No-Fault Divorce and it is, therefore, desirable to reduce our agreement concerning the basis and rate of the legal fee in writing. This letter is to serve as a confirmation of our firm’s representation of you and clarification of the general basis upon which fees will be charged by our firm.  This agreement will become effective upon our receipt of a countersigned copy of this letter and the paid legal fee.

You hereby agree to forward the sum of One Hundred Ninety Five ($195.00) Dollars Pre-Paid Fees to Kimberly D. Kovach, Esquire to ensure the availability of representation for your matter.  The Pre-Paid fee is NOT REFUNDABLE

This fee will cover the following services:

  1. The drafting and filing of a Simple Uncontested No-Fault Divorce Complain in a county in the State of Pennsylvania.
  2. The drafting of the necessary Consents and Waivers for said Divorce as well as other legal documents required in connection with receiving an Uncontested final Divorce and Decree.

This fee will cover the following services:

  1. Kimberly D. Kovach, Esquire will not represent you should your spouse decide to contest your Divorce action.  In Pennsylvania, any Divorce can be contested, even for no reason.
  2. If you start your case with Attorney Kovach and it turns out that your spouse will contest the Divorce, you MUST dismiss Attorney Kovach and hire other legal counsel.  Attorney Kovach WILL NOTrefund to you, your fees paid for work that we have done.  Additionally this agreement does not cover legal services in connection with the pursuit of alimony, division of marital property, removing a spouse’s name from a Deed, settlement agreements, matters of child custody or support, or the re-taking of a maiden name.  These services require an additional fee as set forth in the initial client letter.
    1. Attorney Kovach may, at her discretion and your request, represent you in a contested divorce. However you still MUST dismiss Attorney Kovach in this uncontested divorce matter and enter into a new and separate agreement.

“Service” of the Complaint In Divorce upon your spouse:

Your agreement with Attorney Kimberly D. Kovach does include that service of legal papers will be paid for by the firm to serve your spouse by Affidavit of Service only.  Any other type of service will require an additional expense from you.  You have informed Attorney Kovach of the location and whereabouts of your spouse so that she can appropriately serve him/her.

If for any reason you cannot contact or find your spouse, you must let Attorney Kovach know.  If you start your case with us and it turns out that your spouse cannot be found and served papers upon, you must dismiss Attorney Kovach and hire other legal counsel.  Attorney Kovach WILL NOT  refund to you fees paid for work that we have done.

Our fees for additional service ONLY if you want to request the services:

A.  To draft a Property Settlement Agreement ($150.00)

B.  To remove a spouse’s name from a Deed ($75.00)

C.  To Re-Take your maiden name ($40.00)

Every effort will be made to expedite your case as promptly and efficiently as possibly according to the highest legal and ethical standards.

I am grateful for this confidence you have shown by asking me to represent you.  If you agree to the terms outlined in this Client Authorization Agreement, please sign and return to me this document along with your paid legal fee.

By my signature below I acknowledge that I have read and I understand the basis of the fees to be charged and my responsibility to pay them.  I further understand that should the Divorce become contested by my spouse or my spouse cannot be found and served with legal documents, I MUST dismiss Attorney Kimberly Kovach and hire other legal counsel to pursue this matter.
